The relationship between
the Language School "Escuela de Español Ari Quipay" (EDEAQ) as organiser
and service provider on the one side, and the customer on the other, is
subject to Peruvian law. The site of jurisdiction is Arequipa. The
following conditions as per contract apply: 1. Registration and Terms of Payment Registration for a course should be made by e-mail – only in case of emergency a registration by telephone is possible. Please try to use the form on the registration page in the Internet. Registrations are immediately (i.e. within 48 hours latest) acknowledged by the EDEAQ by e-mail. The EDEAQ does not require a pre-payment (deposit). On the other hand, the EDEAQ does not work with credit cards. If you prefer to pay the total package rate at one time by bank transfer, please let us know, and we will provide you our bank account details; payments can be done in USD (US-Dollars), CHF (Swiss Francs) or € (Euro). Please be informed that all bank charges (including those on our account) will be at your expense.

2.5. 3. Services of the EDEAQ The package price includes:
3.1. Transfer The package price includes the arrival transfer from Arequipa International Airport (AQP) to the host family or to the hotel on check-in day. Non-use of the transfer service does not entitle customers to a reimbursement. Hours of waiting due to late arrivals or delayed or missing luggage may result in an additional transfer surcharge to be paid directly to the EDEAQ. This surcharge will not exceed USD 10.00. 3.2. Tuition Tuition is provided by an experienced and well-trained teaching staff. The quality of instruction measures itself in terms of what is customary and expected in the world of language schools in Latin America and Peru. Lessons falling on workdays (Monday through Friday) that happen to be public holidays in Peru are held whenever possible, in accordance with what students may wish and what teachers may be able to deliver, a) either on that given day or b) after or before. There is, however, no obligation on the part of the school to hold these lessons, either on that given day, or before or after. In the event that classes are suspended due to a public holiday, no reimbursement may be claimed. For missed lessons, including those missed due to reasons beyond the control of the student and/or the EDEAQ (such as illness, accident, etc. of the student), the following rules will be applied: missed one-to-one lessons or Affinity Group lessons (provided that all participants of the Affinity Group miss classes) have not to be paid if the EDEAQ is informed about the nonparticipation not later than at 07.30 h of the tuition day in question; however the EDEAQ will charge a non-recurring fee of USD 6.00 per person/per Affinity Group per tuition day. This fee will not be applied provided the EDEAQ has been informed about the non-participation with a notice of at least three days. – With regard to missed small group and Affinity Group classes, the EDEAQ will apply a 50% charge of the corresponding cost for each missed lesson, unless the EDEAQ has been informed about the non-participation with a notice of at least seven days. Small group tuition at a given performance level can not be guaranteed, in particular during low season. If no group (at least two class participants) can be formed at a given performance level, 14 (Standard) or 16 (Intensive I) or 18 (Intensive II) private lessons per week will be held (without price increase). The place of instruction is Arequipa. Tuition may also be held - in the sense of practical outdoor exercises - outside the premises of the EDEAQ, provided that the student/a group of students so wishes. The EDEAQ can agree to this only if a) the school’s Executive Manager has been informed of this in advance and given his/her consent, b) all of the involved students are willing to absorb all additional costs that may be caused by such an undertaking (whereby the amount of these additional costs will be set by the EDEAQ), and c) these additional costs are prepaid to the EDEAQ. 3.3. Accommodations 3.3.1. Home Stay (Host Family) Accommodations (including breakfast) in an adequately furnished room with an urban middle class host family in Arequipa, with access to WC/hot water shower. Half board (i.e. breakfast plus lunch or dinner) is possible; the additional charge is USD 3.50 per meal per person. The quality of the accommodation and the boarding is measured in terms of what is customary amongst the Arequipa middle class. Under standard conditions - depending upon course duration - students are hosted during 6, 13, 20, 27, etc. days, i.e. the package price always includes a number of consecutive family stay days divisible "through seven, minus one" (one week = 6 days, two weeks = 13 days, three weeks = 20 days, etc.). The charges for an additional day of accommodations are USD 11.00 (single room) or USD 9.00 (double room) per person/per day and are to be paid directly to the EDEAQ. – For overnight accommodations and meals that are not consumed due to the absence of the student or any other reason on the part of the student between the first and the last day of the accommodations, no reimbursement can be claimed (also refer to paragraphs 2.3. and 2.4.). Students staying more than 6, 13, 20, 27, etc. days are not entitled to claim the right to spend the additional days with the originally assigned host family, though in reality this will most likely be the case. The same principle applies when students arrive prior to the Sunday preceding the starting date, or when they leave after the Saturday following the end of the course. If necessary, the EDEAQ will help organise appropriate accommodations alternatives.. 3.3.2. Standard middle class hotel Accommodations in the middle class hotel "Hostal Las Mercedes" **(*), including breakfast. Single room for one person, double room for two people travelling together. In the event that accommodations in the "Hostal Las Mercedes" cannot be arranged, an equivalent hotel in Arequipa will be made available. Under standard conditions - depending upon course duration - students are accommodated during 6, 13, 20, 27, etc. days, i.e. the package price always includes a number of consecutive days divisible "through seven, minus one" (one week = 6 days, two weeks = 13 days, three weeks = 20 days, etc.). The charges for one additional day are USD 18.00 (single room) or USD 13.50 (double room) per person/per day and are to be paid directly to the EDEAQ. For overnight accommodations and meals that are not consumed due to the absence of the student or any other reason on the part of the student, no reimbursement can be claimed, unless: a) the absence coincides with the final departure (i.e. a customer terminates his/her course prematurely), b) the customer has duly checked out and returned the keys to the front desk, and c) the EDEAQ has been informed about the departure at least seven days prior to check-out. If these three conditions are met, a reimbursement may be possible, but not exceeding USD 12.00 (single room) or USD 9.00 (double room) per person/per day.
3.3.3.
Upper middle class
hotel Under standard conditions - depending upon course duration - students are accommodated during 6, 13, 20, 27, etc. days, i.e. the package price always includes a number of consecutive days divisible "through seven, minus one" (one week = 6 days, two weeks = 13 days, three weeks = 20 days, etc.). The charges for additional days are USD 62.00 (single room) or USD 37.00 (double room) per person/per day and are to be paid directly to the EDEAQ. For overnight accommodations and meals that are not consumed due to absence or any other reason caused by the customer, no reimbursement or compensation can be claimed, unless: a) the absence coincides with the final departure (i.e. a customer terminates his/her course prematurely), b) the customer has duly checked out and returned the keys to the front desk, and c) the EDEAQ has been informed about the departure at least seven days before the checking out. If these three conditions are met, a reimbursement may be possible, but not exceeding USD 47.00 (single room) or USD 28.00 (double room) per person/per day. 3.4. Support unrelated to the classroom and touristic information The EDEAQ strives to be as helpful as possible with its customers with regard to the efficient organisation of an interesting stay in Peru. Nevertheless, the type and range of this assistance as well as the amount and flow of information may be limited and the principle of reasonableness will be applied, i.e. that the assistance of the EDEAQ cannot replace the responsibility and the initiative of the customer.
All resulting
expenditures such as telephone or fax fees, transport costs, displays
for photocopies, etc. will be charged to the student. Support unrelated
to the classroom does not mean that there would be an obligation on the
part of the EDEAQ to organise activities students are able to arrange
themselves. Support unrelated to the classroom and touristic information
terminates in principle with the end of EDEAQ's services such as
tuition and/or accommodations. 4. Final Clauses 4.1.
